Terms and Conditions

By creating an account, logging in, uploading an image, making a payment, or using any feature of XrayExplain (the "Service"), you irrevocably confirm that you have read, understood, and agree to be legally bound by these Terms and Conditions ("Terms"), our Privacy Policy, and all applicable Indian laws and regulations.

If you do not agree to these Terms in their entirety, you must immediately cease using the Service and, if applicable, close your account. These Terms constitute a legally binding agreement ("Agreement") between you ("User", "you") and Ajay Vigneshwar GB ("Developer", "we", "us", "our"), the sole developer and operator of XrayExplain.

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 15 days' advance notice via the app interface. Continued use of the Service after the effective date of any modification constitutes your acceptance of the revised Terms.

• You must be at least 18 years of age to use this Service.
• You must possess a valid Indian mobile phone number for OTP authentication.
• By using the Service, you represent and warrant that you meet these eligibility requirements and that the information you provide is accurate and truthful.
• If you are accessing the Service to analyse another person's X-ray (e.g., a family member), you confirm that you have obtained their explicit, informed consent to upload and process their medical imaging data, and that you are legally authorised to do so on their behalf.
• You must not use this Service for any commercial, resale, or professional diagnostic purpose without our prior written consent.

You expressly, knowingly, and irrevocably acknowledge and agree that:

• The AI-generated analysis provided by XrayExplain is not a substitute for professional medical diagnosis, advice, or treatment by a licensed radiologist, physician, or any other qualified healthcare professional.
• AI models, including the models used by this Service, can and do produce inaccurate, incomplete, outdated, or misleading results. X-ray interpretation requires licensed radiologists with clinical context that AI cannot fully replicate. Known AI limitations include false positives, false negatives, and inability to consider full patient history.
• The Service is designed to help you understand your X-ray in plain language — not to replace a consultation with your doctor or specialist.
• We do not guarantee the accuracy, completeness, timeliness, or clinical validity of any AI-generated report. Reports are provided "as is" with no warranty of medical accuracy.
• You must consult a licensed medical professional before making any healthcare decision, including decisions to seek further investigation, start or stop medication, or undergo any procedure.
• You will not use the Service in any emergency situation. In a medical emergency, call 112 (India Emergency Services) immediately.
• Ajay Vigneshwar GB and XrayExplain expressly disclaim all responsibility and liability for any harm, injury, loss, or adverse outcome — whether direct, indirect, or consequential — arising from your reliance on any AI-generated report produced by this Service.

By using the Service, you agree and undertake to:

• Upload only X-ray images that you own, or for which you have explicit legal authorisation to process and share in accordance with these Terms.
• Not upload images of individuals under 18 without explicit, documented consent of a parent or legal guardian, and not without assuming full legal responsibility for such upload.
• Not attempt to reverse-engineer, decompile, disassemble, or extract our AI models, algorithms, prompt structures, or any proprietary component of the Service.
• Not use automated bots, crawlers, scrapers, or any non-human means to access or interact with the Service.
• Not upload any content that is fraudulent, harmful, defamatory, unlawful, or that violates any applicable Indian law including the IT Act, 2000, the IPC, or the POCSO Act, 2012.
• Not attempt to overwhelm, disrupt, or interfere with the Service through DDoS attacks, spam uploads, or similar abusive activity. Any such attempt may constitute an offence under Section 43 and Section 66 of the IT Act, 2000.
• Provide accurate information during registration and payment, and keep your OTP and session token strictly confidential.
• Notify us immediately at aj07.scotia@gmail.com if you suspect unauthorised access to your account.

• Our IP: All software, design, brand elements, trademarks, AI models, prompt architectures, and proprietary algorithms in the Service are owned exclusively by Ajay Vigneshwar GB. Nothing in these Terms transfers any intellectual property rights to you.
• Your X-ray image: You retain full ownership of your X-ray images at all times. By uploading, you grant us a limited, non-exclusive, non-transferable, time-bound licence to process and analyse your image solely for the purpose of generating your report. This licence expires automatically and irrevocably when your data is deleted (within 24 hours of upload).
• Your report: The AI-generated report is provided for your personal, non-commercial use only. You may share it with your licensed healthcare providers. You may not republish, sell, sublicense, or commercially exploit the report in any form.

To the fullest extent permitted by applicable Indian law:

• Ajay Vigneshwar GB and XrayExplain shall not be liable for any medical outcome, health decision, personal injury, death, or harm of any nature arising from reliance on any AI-generated report, analysis, or information provided by the Service.
• Our total cumulative liability for any claim arising out of or related to the Service — whether in contract, tort, negligence, or otherwise — shall not exceed the amount actually paid by you for the specific report that gave rise to the claim.
• We are expressly not liable for indirect, incidental, special, consequential, or punitive damages, including without limitation loss of data, business interruption, loss of revenue, reputational harm, or mental distress.
• We do not warrant that the Service will be uninterrupted, error-free, virus-free, or free from security vulnerabilities at all times.
• We are not responsible for the accuracy, availability, or conduct of third-party AI service providers (OpenAI, HuggingFace, Sarvam AI) or Razorpay, whose services are governed by their own terms and policies.

Nothing in this clause excludes liability for death or personal injury caused by our gross negligence or wilful misconduct, to the extent such exclusion is prohibited by mandatory Indian law.

You agree to fully indemnify, defend, and hold harmless Ajay Vigneshwar GB, XrayExplain, and their respective affiliates, officers, agents, and successors, from and against any and all claims, demands, losses, damages, liabilities, legal fees, and costs of any kind arising out of or relating to:

• Your use or misuse of the Service in violation of these Terms;
• Any medical or healthcare decision made on the basis of our AI reports;
• Your breach of any warranty, representation, or obligation under these Terms;
• Your uploading of medical images of third parties without their informed consent;
• Your violation of any applicable Indian law or third-party rights.

• These Terms are governed exclusively by the laws of the Republic of India, without regard to conflict of law provisions.
• Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall first be subject to a mandatory 30-day good-faith negotiation period from the date of written notice by either party.
• If unresolved after 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu, India.
• Nothing in these Terms prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm.
• Consumer disputes may also be addressed through the National Consumer Disputes Redressal Commission or appropriate State/District Consumer Forum under the Consumer Protection Act, 2019.

We reserve the right to suspend or permanently terminate your account and access to the Service, without prior notice and without refund, if:

• You violate any provision of these Terms;
• We detect fraudulent, abusive, or unlawful activity on your account;
• You attempt to reverse-engineer, circumvent, or exploit any security measure or proprietary component of the Service;
• We determine that continued access poses a security, legal, or reputational risk to the Service or other users.

You may terminate your account at any time by contacting aj07.scotia@gmail.com. Termination does not entitle you to any refund for previously purchased reports.

The Service is provided on an "as is" and "as available" basis, without warranties of any kind — express, implied, or statutory. We specifically disclaim:

• Any warranty of medical accuracy, clinical utility, or fitness for any medical purpose of AI-generated reports.
• Any warranty that AI analysis is equivalent to, or a substitute for, a professional radiological or clinical interpretation.
• Any implied warranty of merchantability or fitness for a particular purpose.
• Any responsibility for the conduct, accuracy, or availability of third-party AI providers (OpenAI, HuggingFace, Sarvam AI) or Razorpay.
• Any warranty that the Service will always be available, uninterrupted, or free from errors or security vulnerabilities.
